Terms and Conditions Statement
This software application (“HeartAware”) and related services (“Services”) are provided by Mobile Innovations LLC (“Mobile Innovations”) through your physician (“Health Care Provider”), which is an authorized licensee of Mobile Innovations entitled to use this Application. Health Care Provider desires to use HeartAware as part of your overall care, and your use of this Application is subject to compliance with the terms and conditions set forth below. Please read the following information carefully.
The Services contain selected, limited health information from your medical record. The Services do not reflect the complete contents of your medical record. A complete copy of your medical record must be requested from the Health Care Provider.
Your continued use of the Application and Services will indicate your agreement to be bound by the terms and conditions set forth below. If you do not agree to be bound by these terms and conditions, please do not access or use Application or Services.
Information Does Not Constitute Medical Advice
MOBILE INNOVATIONS IS NOT A HEALTH CARE PROVIDER AND IS NOT PROVIDING YOU HEALTH CARE SERVICES VIA THE APPLICATION. Mobile Innovations assumes no responsibility for how you use the information you obtain from the Health Care Provider through use of HeartAware. You should consult with the Health Care Provider or other health care professional regarding your own condition.
If you have an emergency, or think you need to speak to someone urgently, please do not use the email communication options provided to you by HeartAware. HeartAware is not a substitute for appropriate and timely contact with your physician. HeartAware is not a substitute for consultation with your physician. You should never change or stop any course of treatment prescribed by your physician without first consulting him or her.
Your privacy is of the utmost importance to us. Mobile Innovations will use your confidential medical information in order to assist the Health Care Provider in providing you services related to your overall health. Mobile Innovations will, at all times, maintain your confidential medical information in strict confidence and will not disclose any information regarding you to any unaffiliated third party unless you authorize that person to receive your information or the information is permitted to be disclosed by law. Please review Mobile Innovations’ Privacy Practices located at www.heartaware.net for a thorough description of how we gather, use and protect your confidential medical information. All messages sent and received within HeartAware that contain medical information are subject to all state and federal laws governing the security and confidentiality of medical records.
- Electronic Messaging
HeartAware should never be used for urgent matters. For all urgent medical matters, please contact the Health Care Provider’s or other physician’s office by phone, go to an emergency room, or dial 911.
- Secure Communications
All communications between you and Mobile Innovations using HeartAware occur over a secure, encrypted connection. All of the confidential medical information available to you in HeartAware is protected and securely maintained by Mobile Innovations.
- Application Access
When your Health Care Provider initially enrolls you in HeartAware, you will receive an email that contains a link that, when tapped on in your smart phone’s email program, will access the HeartAware mobile app, download it, and automatically associate you to the HeartAware solution set up for your Health Care Provider. Your username and password are encrypted and not exposed. In the event you logout of the application, you will enter your email address on the application screen provided to request a new login link via email.
Activities within HeartAware may be tracked by computer audit and entries made may become part of the patient’s medical record.
Termination of Access
Mobile Innovations may restrict or terminate access to HeartAware at any time. If access is restricted for planned maintenance of the HeartAware system, such downtime will normally be planned for nighttime/early morning hours. If your use of HeartAware violates these Terms and Conditions, Mobile Innovations reserves the right to permanently terminate your access to HeartAware.
Restrictions on Use and Ownership
HeartAware is the property of Mobile Innovations. The content within this Application is provided for Health Care Provider and its patients only. The words “Mobile Innovations”, “HeartAware” and its associated logos are the trademarks and service marks of Mobile Innovations. All other trademarks, service marks, and logos used in this Site, including, but not limited to Health Care Provider, are the trademarks, service marks, or logos of their respective owners. Nothing in connection with your use of HeartAware should be construed as granting any license or right to use any trademark, service mark, or logo displayed within the Application without the express permission of Mobile Innovations or the third party that may own the trademark, service mark, or logo.
Accuracy and Integrity of Information
Although Mobile Innovations attempts to ensure the integrity of HeartAware, it makes no guarantees whatsoever as to the correctness or accuracy of information transmitted via the Application. It is possible that the Application could include typographical errors, inaccuracies or other errors. In the event that an inaccuracy arises, please inform the Health Care Provider so that it can be corrected.
